	This website www.CMDNhotjobs.com and/or any part thereof (“Website”) is owned by Cordiant Technologies (P) Limited, (“Site Owner”). For the purpose of these Terms of Use, the expression “User” shall mean any person (including a Registered User) who accesses or uses the Website and the expression ‘Registered User’ shall mean a User who has registered himself/herself with the Website for availing the services provided therein. The Site Owner hereby grants the User a non-exclusive, non-transferable, limited license to use the Website, subject to the unconditional acceptance of the terms of use governing this Website. The User hereby agrees to familiarize himself/herself with the Terms of use as well as other terms and guidelines found throughout this Website and abide by them. If the User is dissatisfied with the Website or any portion thereof, or with any of these Terms of use, the User’s sole and exclusive remedy is to discontinue using this Website. The Website is deemed to be used by the User when it is accessed by the User by any means and/or when it is loaded and/or continues to be loaded in the temporary or permanent memory of the User’s computer or a similar system or in the internet browser thereof. The Site Owner’s own records of the use of the Website and transactions concluded therein, maintained through computer systems or otherwise shall be accepted as conclusive and binding for all purposes. The User’s use of this Website may be terminated at any time by Site Owner at the sole and absolute discretion of the Site Owner, without any reason or notice being required to be given to the User. The User understands and agrees that Site Owner is a NETWORK SERVICE PROVIDER and an INTERMEDIARY within the meaning of Sec. 79 of the Indian Information Technology Act, 2000 and that the Website merely provides hosting services to its Registered Users and viewing facilities to persons browsing / visiting the Website. All the information posted therein has been posted by Registered Users and is third party user generated content. The Site Owner neither initiates the transmission nor selects the sender and receiver of the transmission nor selects / modifies the information contained in the transmission. The Site Owner has no control over the third party user generated content and shall not be liable for such content.

	Users Account and Registration Obligations
	The User (“Job Seeker” or “Employer”) can view all Jobs posted on the Website without registering on the Website. However, certain other activities on the Website for including but not limited to Job Postings etc require the User to register on the Website. The User Shall be required to provide some personal / company information, when the User creates a Registered User Account, including the User’s email address, which is used to protect the Registered User’s account from unauthorized access. If a User uses the Website, the User shall be responsible for maintaining the confidentiality of the User’s ID and Password and for restricting access to User’s computer, computer system and computer network. The User shall be responsible for all activities conducted under the User’s ID.

	The User agrees, inter alia, to:
	Provide true, accurate, current and complete information about the User in the registration form required to be filled in to create a Registered User Account (such information being the "Registration Data") Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provides any information that is untrue, inaccurate, not current or incomplete, or if the Site Owner has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms of use, the Site Owner has the right to indefinitely suspend or terminate the User’s registration with the Website and refuse to provide the User with access to the Website Unless specifically agreed to by the Site Owner in writing, no content from this Website may be used, reproduced, transmitted, distributed or otherwise exploited in any way. The User understands and acknowledges that the Website is intended only for displaying Jobs posted by Employers for Job seekers. The User (“Employer”) hereby agrees to upload only accurate information relating to Jobs. The User agrees not to set up fictitious Jobs or upload any matter/information relating to fictitious Jobs. If the User (“Job Seekers”) comes to know of any Job on the Website that is fictitious/false or otherwise not in conformity with the Terms of use or otherwise offends the User in any manner, the User agrees to immediately send a complaint to info@CMDNhotjobs.com enabling the Site Owner to take appropriate action. The Services provided by the Website also include certain services that are available via third party Job sites, including Jobs collated from other Jobs sites. The Site Owner does not charge the User (“Employer”) for these Job Posts. However, access to third party Websites is at the User’s own risk and the Site Owner will not be responsible for any information on the se respective sites or loss of data on account of the use by the User on third party websites.

	The User agrees not to submit, use and /or cause the storage into the Website, any information that
	is defamatory, abusive, harassing, threatening, or an invasion of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms any person or entity; is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including a posting or submission that is, or represents an attempt to engage in, child pornography, stalking, sexual assault, fraud, trafficking in obscene or stolen material, drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity; infringes or violates any right of a third party including: (a) copyright, patent, trademark, trade secret or other proprietary or contractual rights; (b) right of privacy (specifically, the User must not distribute another person's personal information of any kind without the prior written permission of such other person) or publicity; or (c) any confidentiality obligation; Is commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations); contains a virus or other harmful component, or otherwise tampers with, impairs or damages the Website or any connected network, or otherwise interferes with any person or entity's use or enjoyment of the Website; or Is antisocial, disruptive, or destructive, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet. Do not generally pertain to the designated topic or theme. The User understands and accepts the fact that the Site Owner cannot and does not assure the User that other Users will comply with these Terms or any other provisions of these Terms of Use, and, as between the User and Site Owner, the User hereby assumes all risk of harm or injury resulting from any such lack of compliance. The User shall not use the Website for commercial purposes (without the prior written authorization of Site Owner) or in any way that is unlawful, or harms the Site Owner or any other person or entity, The Site Owner’s decision with regard to the above use shall be final and binding on the User. All commercial uses without Site Owner’s express approval including any of the following actions are prohibited:
	Sale of access to the Website or its related services (such as the ‘Scorecaster’) on another Website; Use of the Website or its related services (such as the ‘Scorecaster’), for the primary purpose of gaining advertising or subscription revenue; The sale of advertising, on the Website or any third-party Website, targeted to the content of specific User Submissions or the Website content; Any use of the Website or its related services (such as the ‘Scorecaster’) that Site Owner finds, in its sole discretion, amounts to use of the Website's resources or User submissions for the purpose of or has the effect of competing with or displacing the market for the Website content, or its User submissions. Any use of the Website not expressly authorized in writing.
	The User understands and acknowledges that the User may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and the User agrees to waive, and hereby does waive, any legal or equitable rights or remedies the User has or may have against the Site Owner or the Website with respect thereto, and agrees to indemnify and hold Site Owner, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to the use of the Website by the User. The User is prohibited from using another User’s account without obtaining the prior permission of such other User. The User is solely responsible for the activity that occurs on the User’s account, and the User must keep the User's account password secure. The User must notify the Website immediately, in the event of any breach in security or unauthorized use of the User's account. The Site Owner assumes no responsibility for the completeness and/ or availability of information posted/submitted by Registered Users on the Website. Although the Site Owner will not be liable for the User’s losses caused by any unauthorized use of the User's account, the User shall be liable for the losses of the Site Owner or others due to such unauthorized use of the User's Account. The User agrees not to alter or modify any part of the Website, including but not limited to the ‘Scorecaster’(patent pending) or any of its related technologies. Further, the User shall not:
	Reverse engineer, decompile, disassemble, copy, reproduce, distribute, modify, transmit, perform, publish or create derivative works from or in any way exploit any part of the Website in violation of the Terms of use or the laws of any country Create a database in electronic or structured manual form by systematically downloading and storing the entire Website or part thereof except such information as relates or concerns the User. Cache or permit caching by any person. Commit any act that violates the Site Owner’s intellectual property rights in the Website. Engage in any fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information relating to any other user. Use the Website to violate the security of any computer or computer network, crack passwords or security encryption codes, transfer or store illegal material including threatening or obscene material or engage in any kind of illegal activity. Run a mail list or any form of auto-responder, or spam on the Website or any processes that are run or are activated while the User is not logged on or engage in any virus attack or denial of service, attach or engage in any activity designed and/or intended to interfere with the working of Website for any duration of time.
	The User agrees not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, the Site Owner grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. The Site Owner reserves the right to revoke these exceptions either generally or in specific cases. The User agrees not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. The User agrees not to solicit, for commercial purposes, any other Users of the Website. In the use of the Website, the User shall otherwise comply with these Terms of use and all applicable local, national, and international laws and regulations. The Site Owner reserves the right to discontinue any aspect of the Website at any time.

	Account Termination:
	The Site Owner will terminate a User's access to the Website if the User is determined to be an infringer. The Site Owner reserves the right to decide whether a User Submission is appropriate and is not in violation of these Terms of use but not limited to, the prohibitions relating to display/ submission of pornography, obscene or defamatory material on or in relation to the Website. The Site Owner may remove any User Submissions and/or terminate a User's access for uploading any material in violation of these Terms of use at any time, without prior notice and at its sole discretion. Site Owner reserves the right to deny, at its sole discretion, any User access to this Website or any portion thereof without notice.

	PRIVACY

	Personal Information
	Non-Account Activity. No information / registration details are required to view Jobs posted on the Website. Account-Related Activity. Certain other activities on the Website like Upload resume or Jobs Posting etc —require the User to have a Registered User Account. The User is required to provide some personal information when the User creates an account, which personal information includes the User’s email address, which is used to protect the User’s account from unauthorized access. A Registered User Account allows the User to access many of the Website’s services that require registration. Usage Information. The Site Owner records information about the User’s usage, such as when the User used the Website, Jobs the User subscribed to, the Employer contact the User communicated with, the Jobs which the User’s viewed and the frequency and size of data transfers, as well as the information the User displayed on the Website (including UI elements, settings, and other information). If the User is logged in, the Site Owner may associate that information with the User’s account. The Site Owner may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to Users to track which emails are opened by the recipients. Content Uploaded to Site. Any personal information discloses online becomes publicly available and can be collected and used by others.
	Uses
	If the User submits personally identifiable information to the Site Owner through the Website, the Site Owner may use the User’s personal information to operate, maintain, and provide the User with general and personalized features and functionality on the Website, and process any flagging activity or correspondence the User sends to the Site Owner. The User’s account name is displayed to other Users when the User uploads information or sends messages through the Website and other Users can contact the User through messages and comments. Any information that the User submits to the Website may be redistributed through the internet and other media channels, and may be viewed by the general public. The Site Owner does not use the User’s email address or other personally identifiable information to send commercial or marketing messages without the User’s consent or except as part of a specific program or feature for which the User will have the ability to opt-in or opt-out. The Site Owner may, however, use the User’s email address without further consent for non-marketing or administrative purposes (such as notifying the User of major Website changes or for customer service purposes). The Site Owner uses both the User’s personally identifiable information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, click stream data, etc.) to improve the quality and design of the Website and to create new features, promotions, functionality, and services by storing, tracking, analyzing, and processing User preferences and trends, as well as User activity and communications. The Site Owner uses cookies, clear gifs, and log file information to: (a) store information so that the User will not have to re-enter the same during the User’s next visit; (b) provide customized, personalized content and information; (c) monitor the effectiveness of the Website’s marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track the User’s entries, submissions, and status in promotions, sweepstakes, and contests.

	Information that is publicly available
	When the User creates an account on the Website, some information about the User’s account and the User’s account activity will be provided to other Users of the Website. This may include the date the User opened the User’s account, the date the User last logged into the User’s account, the User’s contact details (if the User chooses to make it public), the country / location and the number of information relating to Jobs the User has applied for Jobs. The User’s account name is displayed to other Users when the User engages in certain activities on the Website, such as when the User uploads information or sends messages through the Website. Other Users can contact the User through messages and comments. Any information that the User submits to the Website can be redistributed through the internet and other media by the Site Owner, without obtaining any consent from the User, and may be viewed by the general public.
	The User’s Choices
	The User may, of course, decline to submit personally identifiable information through the Website, in which case the User can still view Jobs posted on the Website, but the Website may not be able to provide certain services to the User. Some advanced features may, for authentication purposes, require the User to sign up for other services. The privacy notices of those services govern the use of the User’s personal information associated with them. The User may update or correct the User’s personal profile information at any time.

	Third-party Advertisers, Links to Other Sites
	The Site Owner allows other companies, called third-party ad servers or ad networks, to display advertisements within the Website. These third-party ad servers or ad networks use technology to send advertisements and links that appear on the Website directly to the User’s browser. They automatically receive the User’s IP address when this happens. They may also use other technology (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content the User sees. 	Payments
	All Job Posts are accepted on the basis that they will be paid for at the applicable rates set out in the Job Packages on the date of publication, or other rates have been expressly agreed in writing between any Employer and CMDNhotjobs. Payment shall be made by credit/debit card at the time your Advertisements are uploaded onto the Service. CMDNhotjobs accepts the following cards: Visa, MasterCard, Maestro. All payments shall be made in Indian Rupees (INR) and without deduction or withholding of any fund, other than as required by law. All rates are subject to addition of Service Tax and/or other applicable sales or other taxes.

The Site Owner may transfer or assign its rights and obligations under this contract to any third party without requiring any consent of the Registered Users or any other Users. The Registered User agrees that his/her User ID and password shall be used by him / her alone and shall not be transferred / assigned or permitted to be used by any other person. The Website, these Terms of use and the User’s use of the Website is governed solely by Indian law irrespective of where the whole or any part of the data or Website may be physically located and without regard to conflict of law principles in other jurisdictions. Use of this Website is unauthorized and prohibited in any jurisdiction that does not give effect to all provisions of these Terms including without limitation, this paragraph. The Site Owner accepts no liability whatsoever, direct or indirect for non-compliance by the user with the laws of any country other than that of the Republic of India. The User agrees that the Courts in the city of Chennai, Tamil Nadu, India, alone shall have jurisdiction with regard to any dispute between the User and the Site Owner excluding all other Courts anywhere in the world that may otherwise have had such jurisdiction.
